Important PRV scoring notes:
Score each PRV by selecting the highest applicable point value within that variable. MCL 777.51 to MCL 777.57.
All prior convictions must satisfy the 10-year gap requirements of MCL 777.50.
A “conviction” includes assignment to the Holmes Youthful Trainee Act (HYTA) and convictions set aside (expunged) under MCL 780.621 to MCL 780.624.
Used to guide PRV 4 and PRV 5 scoring changes that depend on whether the offense was committed before or on/after October 1, 2000.
PRV 1: Prior High Severity Felony Convictions
MCL 777.51. High severity includes Class M2, A, B, C, or D; and, for offenses committed on or after January 9, 2007, certain unclassified felonies punishable by 10 years or more.
PRV 2: Prior Low Severity Felony Convictions
MCL 777.52. Low severity includes Class E, F, G, or H; and, for offenses committed on or after January 9, 2007, certain unclassified felonies punishable by less than 10 years.
PRV 3: Prior High Severity Juvenile Adjudications
MCL 777.53. For offenses committed on or after January 9, 2007, includes certain unclassified felonies punishable by 10 years or more.
PRV 4: Prior Low Severity Juvenile Adjudications
MCL 777.54. The scoring table changes depending on whether the sentencing offense was committed before or on/after October 1, 2000.
PRV 4 counts juvenile adjudications for conduct that would be Class E, F, G, or H felonies (and, for offenses committed on or after January 9, 2007, certain unclassified felonies punishable by less than 10 years), if the disposition was entered before the sentencing offense was committed.
PRV 5: Prior Misdemeanor Convictions or Prior Misdemeanor Juvenile Adjudications
MCL 777.55.
Do not count a prior misdemeanor conviction or adjudication if it was used to enhance the sentencing offense to a felony.
For offenses committed on or after October 1, 2000, only certain misdemeanor categories may be counted (offenses against a person or property, controlled substance offenses, weapon offenses), plus all OWI-type operating offenses listed in the statute.
PRV 6: Relationship to Criminal Justice System
MCL 777.56.
PRV 6 is assessed based on the offender’s relationship to the criminal justice system at the time the sentencing offense was committed.
“Delayed sentence status” includes, among other examples, HYTA assignment, MCL 333.7411 deferrals, and other statutory deferrals.
PRV 7: Subsequent or Concurrent Felony Convictions
MCL 777.57.
A felony-firearm conviction may not be counted under PRV 7, and certain concurrent felonies that will result in consecutive sentences may not be counted.
